These Terms govern your use of LUMERA's website and services. By using our site, you agree to these Terms and our Privacy Policy. If you disagree, please do not use our services.

1. ELIGIBILITY & ACCOUNTS

You must be at least 20 years old (the age of majority in Thailand) or have parental consent to use our services. You are responsible for maintaining account security and for all activity under your account. Provide accurate information and keep it updated.

2. PRODUCTS & DESCRIPTIONS

We strive for accurate product descriptions, but colors and appearance may vary due to screen settings. Product images are for illustration purposes.

Collectibles Notice: Condition grades (e.g., Mint, Near Mint, Excellent) follow industry-standard definitions provided in each listing. Minor variations in packaging or manufacturing are normal for collectible items and do not constitute defects. We do not guarantee future value appreciation of any collectible.

Authenticity: All Japanese items are guaranteed authentic and imported directly from Japan. Artist items are sourced directly from the artists we collaborate with.

Blind Boxes, Blind Bags & Gachapon: Many of our products are sold in "blind box", "blind bag", or gachapon capsule format, where the specific item inside is random and cannot be chosen. For gachapon capsules, our team randomly selects capsules without bias. By purchasing these items, you acknowledge and accept the random nature of the contents. Full sets may be available where stock permits — contact our team to arrange. See our Refund Policy for return eligibility.

We may modify or discontinue products without notice and may limit quantities per customer.

3. ORDERS & PRICING

Placing an order is an offer to purchase. We may accept or decline orders at our discretion. Orders are confirmed only when we send an acceptance email. Prices are in Thai Baht unless stated otherwise and exclude shipping, taxes, and customs duties.

Pre-orders: Pre-orders allow you to lock in an order at a discounted price for products we have ordered but have not yet imported. Payment is required at time of order. Release dates are estimates and may change. The maximum processing and delivery time for pre-order items is 2 months from the date of order. Pre-orders cannot be cancelled once placed. In the event a pre-order exceeds the 2-month period, we reserve the right to cancel the order automatically and issue a full refund to the original payment method, or to contact you to confirm whether you wish to continue waiting for the item.

Limited Editions: Limited edition items are sold first-come, first-served. We reserve the right to cancel duplicate orders from the same customer.

Returns and refunds are governed by our separate Refund Policy. All purchases must be for personal use, not commercial resale.

4. PAYMENT

You agree to pay all charges at the posted prices plus applicable fees. You warrant that your payment information is accurate and that you are authorized to use the payment method. We accept payment via bank transfer, credit card, and certain digital wallets. Payment method availability is subject to change.

5. SHIPPING & DELIVERY

Shipping methods, fees, and expected delivery timeframes are detailed in our Shipping Policy. Delivery times are estimates only. We are not liable for carrier delays, customs processing, or events beyond our control. Risk of loss passes to you upon delivery to the carrier. International buyers are responsible for import duties and taxes.

6. INTELLECTUAL PROPERTY

All content on our site (text, images, logos, designs) belongs to LUMERA or our licensors. You may not copy, distribute, or use our content without written permission. LUMERA and our logos are our trademarks.

7. USER CONTENT & FEEDBACK

By submitting reviews, comments, or other content, you grant us a perpetual, royalty-free license to use, modify, and display such content. You warrant that your submissions are original, lawful, and do not infringe third-party rights. We may remove content at our discretion.

8. PROHIBITED CONDUCT

You may not: use our services for unlawful purposes; infringe intellectual property rights; harass or harm others; transmit malicious code; scrape or crawl our site; attempt to circumvent security features; or resell products commercially. We may terminate accounts for violations.

9. THIRD-PARTY LINKS & TOOLS

Our site may contain links to third-party websites or tools. We are not responsible for their content, accuracy, or practices. Use them at your own risk.

10. SHOPIFY

Our store is powered by Shopify. All transactions are between you and LUMERA, not Shopify. You release Shopify from all claims related to your purchases from us.

11. PRIVACY

Your personal information is handled according to our Privacy Policy and Thailand's Personal Data Protection Act (PDPA). By using our services, you consent to our data practices as described in our Privacy Policy.

12. DISCLAIMER OF WARRANTIES

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY THAI LAW, LUMERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS.

14. INDEMNIFICATION

You agree to indemnify LUMERA against any claims, damages, or expenses arising from your breach of these Terms, violation of law, or infringement of third-party rights.

15. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in the courts of Thailand. Nothing in these Terms limits your rights under the Thai Consumer Protection Act.

16. CHANGES TO TERMS

We may update these Terms at any time by posting the revised version on our site. Material changes will be notified via email or site notice. Continued use after changes constitutes acceptance.

17. GENERAL

If any provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a right does not waive it. These Terms constitute the entire agreement between you and LUMERA. You may not assign your rights under these Terms without our consent.
